New Telephone Communication Law Enforcement Begins: Are You Prepared?
What is the Telephone Communications Protection Act (also known as the TCPA)? It’s a comprehensive law that was originally passed in 1991, which over the years, has been updated several times to reflect changes in telephone usage. It is the same law that established a national Do Not Call registry. It was also used to establish a CAN-SPAM Act and it is also the law that regulates fax blasts. Each time the law has been changed businesses in general have had to change their processes to remain compliant. For example, dealerships had to put a process in place to check phone numbers against the Do Not Call list when the registry was created. They did however have one exemption that allowed an 18 month window to call someone on the list if you had an established business relationship. Has something else changed in the law, dealers need to be aware of? Yes, the latest changes to the law went in effect in February 2013, but the enforcement was delayed until October 16, 2013.
